In accordance with the Electricity Act 2023, the Nigerian Electricity Regulatory Commission (NERC) has issued an order transferring regulatory oversight of the electricity market in Imo State to the Imo State Electricity Regulatory Commission (ISERC).
The order, signed by NERC Chairman Sanusi Garba, will take effect on July 1, 2024.
As a result, Imo State will assume full responsibility for regulating its electricity market. The order specifies that Section 230(3) of the Act requires NERC to create a transition plan and timeline for transferring regulatory oversight of the intrastate electricity market from NERC to ISERC upon formal notification from the state.
Additionally, the Enugu Electricity Distribution Company (EEDC) is required to complete the incorporation of EEDC SubCo within 60 days from the effective date of the order. EEDC SubCo must then apply for and obtain a license for intrastate supply and distribution of electricity from ISERC.
Furthermore, EEDC will delineate the actual geographic boundaries of Imo State, establishing its network as a standalone system within the state. Boundary meters will be installed at all border points where the network crosses from Imo State into neighboring states.
With this development, Imo becomes the fourth state to receive electricity regulatory authority, following Enugu, Ondo, and Ekiti states.
