An FCT High Court in Kubwa has dismissed a N1 billion lawsuit against former Minister of Justice and Attorney-General of the Federation, Abubakar Malami, while he was in office.
The suit, which also named civil servant Asabe Waziri and two others – the office of the former minister and the Federal Ministry of Justice – was brought by Abuja-based property developer, Cecil Osakwe.
However, Justice Oluyemisi Adelaja struck out the case due to a lack of diligent prosecution by Osakwe.
The court ordered the case struck out for want of diligent prosecution as the claimant failed to appear before the court without any reason.
The lawsuit stemmed from allegations of advance fee fraud and criminal intimidation against Osakwe, who had sold a property to Ms. Waziri for N130 million.
Following a two-count charge against Osakwe by the Federal Government, he proceeded to file a lawsuit against Malami, seeking punitive damages of one billion naira and general damages of one hundred million naira jointly and severally from the defendants.
