The Nigerian Electricity Regulatory Commission (NERC) has granted authorization to Ondo, Ekiti, and Enugu States, empowering them to independently determine their electricity tariffs.
Additionally, NERC has approved their capacity to generate, transmit, distribute, and regulate electricity within their respective territories, granting them autonomy in electricity regulatory matters.
The regulator has endorsed the establishment of independent electricity regulatory commissions in these states. Sanusi Garba, the Chairman of NERC, disclosed this information during an oversight visit by members of the Senate Committee on Power to the commission’s office on Tuesday.
Garba highlighted that these three states now have the autonomy to regulate tariffs and manage power supply within their jurisdictions.
However, he clarified that in instances where these states procure power from the national grid, NERC will continue to oversee and regulate such transactions.
This means that states will have the authority to determine the cost of electricity per kilowatt-hour based on specified bands.
In compliance with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act 2023 (Amended), NERC issued orders to transfer regulatory oversight of the electricity market in these states from the commission to their respective regulatory bodies.
This development comes after 12 states applied to NERC seeking electricity regulatory bodies separate from the federally-owned commission.
