Justice James Omotoso of the Federal High Court in Abuja has denied an urgent request by Edo State’s Deputy Governor, Philip Shaibu, for a temporary order to halt his impeachment by the state legislature.
Shaibu had filed for a court order to prevent the third through fifth defendants from initiating any impeachment proceedings or forming any investigative panels against him until a formal motion could be heard.
Additionally, he sought a provisional injunction to stop the defendants from meddling with the legal proceedings aimed at his ouster as Deputy Governor of Edo State, pending the resolution of the motion on notice and other related requests.
Nonetheless, Justice Omotoso, in a decision made on March 13 but only reported on Monday, rejected Shaibu’s request for immediate legal relief.
The court’s decision was clear: “The Motion Expartee for Interim Injunction, submitted on March 8, 2024, is hereby denied.”
In the latest court session on Tuesday, the judge scheduled a hearing for Wednesday on another urgent motion by Shaibu, which seeks alternative means to serve the defendants, as direct service has proven unsuccessful.
