The Supreme Court has overturned a ruling by the Court of Appeal that had set aside an inspection order granted to the Social Democratic Party (SDP) candidate by the Governorship Election Petitions Tribunal in Abuja.
The tribunal had granted an ex-parte order on November 25, 2023, allowing the SDP and its candidate to conduct a forensic examination of all the Bimordal Voters Accreditation System (BVAS) used in the November 11, 2023 governorship election, among other requests.
A three-judge panel at the Court of Appeal, led by Justice J.O.K. Oyewole and including Justices A. I. Banjoko and A.B. Mohammed, set aside the inspection order, stating that it exceeded the provisions of the Electoral Act.
However, in a judgment delivered by Justice Emmanuel Agim, the Supreme Court allowed the appeal of the appellants, affirming that the trial tribunal had the authority to issue the inspection order, and also confirmed that the respondents were properly served.
